The “WIN 1 OF 100 $40 eGIFT CARDS” competition (Competition) is conducted by Hygain Feeds ABN 53 097 343 827 of 10 Hickson Rd, Officer VIC 3809 (Promoter).
Any information provided about prizes and how to enter the Competition also forms part of these Competition Terms and Conditions (Terms).
By submitting an entry for the Competition (Entry), persons who enter the Competition (Entrants) agree to these Terms.
ELIGIBILITY
Entry into the Competition is open to New South Wales residents (NSW Entrants) over the age of eighteen (18) years who comply with the below eligibility requirements. Employees of the Promoter (and members of their immediate family), employees of salons associated with the Promoter (Hygain Feeds) and agencies associated with this Competition (and members of their immediate family) are ineligible to enter.
For the avoidance of doubt “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
To be eligible to participate in the Competition an Entrant must be 18 years of age. Purchases made by a person that is under 18 years of age will entitle their parent or guardian to enter the Competition on their behalf.
PRIZES
There is a total of one hundred (100) individual prizes (Prizes and each a Prize), each a $40 gift card of the Prize winner’s choosing from a list at https://www.giftpay.com.au/business/egifts.aspx and subject to availability.
The Prize will be delivered to each winner by email to the winner’s nominated email address by the Promoter within twenty-one (21) days of the Draw Date.
The total value of the prize pool for Entrants is $4,000.
Gift Card Terms: Any ancillary costs associated with redeeming the gift card are not included. Prizes cannot be exchanged for cash and any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card.
ENTRIES
Entries to the Competition must be submitted between 09:00 am on 1 September 2021 and 11:59 pm on 31 October 2021 (the Competition Period).
To enter the Competition and be eligible to win a Prize, Entrants must:
Visit the competition entry page available at https://hygain.com.au/pages/win-1-of-100-40-egift-cards;
complete all fields on the entry page, including without limitation full name, email address, valid mobile phone number, State or Territory, postcode, upload a photo of their receipt/s showing purchase of (minimum) 2 Hygain feed products, tell us in 25 words or less why they use their current feed;
consent to receive marketing communications from the Promoter;
submit the form to go into the draw for a chance to win a Prize; and
if requested, provide reasonable proof of your identity to claim a Prize.
TERMS OF COMPETITION
All Entries must be received by the Promoter within the Competition Period in the form specified and the Promoter will not accept any liability for Entries which are rejected because they are late, lost, incomplete, incorrect or otherwise not able to be received or processed.
The winning Entrants are those persons whose Entry is judged in accordance with the process set out below.
Entrants must enter the Competition in their own name. Multiple entries are strictly prohibited and each Entrant may only enter the Competition once. Further entries by the Entrant will be deemed invalid.
Entrants are responsible for any and all expenses incurred when entering and accessing the Competition and/or claiming a Prize, unless otherwise stated.
RECORDS
All Entries become the property of the Promoter. Entrants acknowledge that their Entry and all material included in the Entry will be the property of the Promoter. The Entrant grants the Promoter a world-wide, royalty free, exclusive, assignable licence to use the material that it provides as an Entrant to the Competition. The licence under this clause will survive the expiry of the Competition Period.
The records of Entries by Entrants are final and conclusive as at the time of submission. Incomplete, invalid, indecipherable Entries and those that do not meet the eligibility requirements will be deemed invalid.
The Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant and the validity of the Entry if there is a dispute.
The Promoter reserves the right in its sole discretion to disqualify any Entry if the Promoter has any reason to believe that the Entrant has breached these Terms or engaged in any unlawful or other improper misconduct relating to the Competition.
PRIZES:
The judging of the winners will take place at Hygain Feeds, 10 Hickson Rd, Officer VIC 3809.
The Judges will award the prize in the promotion to the Participant who is responsible for the most creative entry to the question "Tell us in 25 words or less why you choose this feed," as deemed by them during the promotion period. This is a game of skill. The judging will take place within the first 14 business days after the end of the promotion period. The winners will be notified via email 14 business days after the end of the promotion period.
The Promoter will award one Prize to each winner. The winner will be awarded a $40 gift card redeemable on a gift card of the winner’s choosing from a list at https://www.giftpay.com.au/business/egifts.aspx and subject to availability.
The Promoter will notify the winners by the email address or mobile phone number that they used to submit the Entry that they have won a Prize and will also be announced on the Hygain® Australia Facebook Page. on the following business day after the Draw Date.
If a Prize is not accepted or claimed by a winner within 3 calendar months of the Draw Date, another draw will take place at the same place as the original draw, 3 calendar months from the original Draw Date and subject to any directions from a regulatory authority. The new winner will be notified in accordance with clause 23.
The Promoter reserves the right to select a different Entrant to receive the Prize, subject to clause 24 and any directions from a regulatory authority.
The Promoter’s decision is final in relation to the Prizes, and no correspondence will be entered into, including in the event of a dispute.
GENERAL
By submitting an Entry to the Competition, Entrants are consenting to send their personal information to the Promoter. All information collected will be treated in accordance with the Promoter’s Privacy Policy available at https://hygain.com.au/pages/hygain-group-privacy-policy-2021. Entries are not confidential.
Entrants agree to the use of their first name, last name, photograph, social media handle and suburb for publicity and Competition purposes and promoting any products manufactured, distributed and/or supplied by the Promoter. The Entrant will not receive any compensation or remuneration for the use of this information or the publicity derived from it.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct or indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third-party interference;
any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in prize value to that stated in these Terms;
any tax liability incurred by an Entrant or winner; or
use of a Prize.
Prizes cannot be exchanged or transferred by the winner. If any Prize is unavailable for whatever reason, the Promoter reserves the right to substitute the Prizes in accordance with Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), subject to written directions of the relevant regulatory authority. The Prize must be taken as offered and cannot be varied by the winner. The Promoter retains the right to substitute the Prizes with prizes of equal or greater value or a portion of the Prizes with a portion of equal or greater value.
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter or a force majeure event, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
to disqualify any Entrant; or subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
The Promoter will give public notice of such an event and that the promotion has been modified, suspended, terminated or cancelled (as appropriate).
For the avoidance of doubt a ‘force majeure event’ includes, but is not limited to, an act of god, fire, explosion, vandalism, storm or other similar occurrence, orders or acts or military or civil authority, or by national emergencies, insurrections, riots, or wars, strikes, lockouts and work stoppages, terrorism, infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.
These Terms are governed by the laws of Australia and the state of New South Wales. Entrants submit to the exclusive jurisdiction of the courts operating in Australia and the state of New South Wales.
These Terms may be amended or replaced from time to time if required by any regulatory authority.
References to time/s and deadline/s in these Terms refer to Australian Eastern Daylight Savings Time during summer in Australia and Australian Eastern Standard Time during winter in Australia.
References to business day means a day which is not a Saturday, Sunday or a bank or public holiday in the state of New South Wales.
References to dollars or $ is a reference to Australian dollars.
